1. Who these terms apply to

These terms govern your use of brianitumo.recruitmentroom.net (the "site") and any advisory, executive search, talent intelligence, workforce strategy, career service, coaching, consultation or referral service provided by Brian Itumo ("I", "me", the "advisor").

By using the site, submitting a form, booking a consultation, registering referral interest or purchasing a service, you accept these terms. If you do not accept them, please do not use the site or the services.

2. Nature of the services

All services are advisory, consultative, coaching or introduction-based in nature. They are provided on a reasonable-efforts, best-practice basis and do not constitute legal, financial, immigration, tax, medical or employment law advice.

Where an engagement involves executive search, talent intelligence, workforce strategy or AI recruitment advisory, deliverables are recommendations, research, frameworks, mappings and introductions. Acting on them, and the results of doing so, remains your decision and responsibility.

3. No guarantee of employment, hiring or business outcomes

I do not guarantee employment, interviews, shortlisting, offers, salary levels, visas, relocation, promotions, placements, candidate acceptance, retention or any commercial result.

The final hiring decision lies solely with the hiring company. Results depend entirely on role availability and on decisions made by the hiring team, including their timelines, budgets, internal politics, changes of scope, hiring freezes and candidate preferences — all of which are outside my control.

Career services, coaching, resume and profile work, interview preparation and RR JobCopilot support improve how you are positioned. They do not create, promise or guarantee a job, an interview or an offer.

Referrals are introductions only. Registering interest in a mandate does not create any entitlement to be presented, interviewed, shortlisted or hired, and I may decline to refer any candidate at my sole discretion.

4. Your responsibilities

You confirm that all information you provide — including your identity, seniority, experience, qualifications, location, work authorisation, LinkedIn profile and contact details — is accurate, current and lawfully yours to share.

You are responsible for your own due diligence on any employer, role, offer, contract, compensation package or jurisdiction, and for obtaining independent legal, tax, financial or immigration advice where relevant.

You must not submit false, misleading, defamatory, discriminatory or unlawful content through any form on the site, and you must not use the site to scrape data, send spam or interfere with its operation.

5. Fees, payments and refunds

Fees for career services and advisory engagements are as quoted at the point of purchase or in a written proposal or statement of work. Unless expressly agreed in writing, fees are payable in advance and are non-refundable once work has commenced, because the value delivered is time, expertise and market access rather than a guaranteed outcome.

Where a package includes a fixed number of sessions, documents or revisions, unused elements expire as stated in that package and are not exchangeable for cash.

Missed consultations without at least 24 hours' notice may be treated as delivered.

6. Confidentiality and data

Information you share is treated as confidential and used only to assess fit, deliver the service you requested and communicate with you about it.

Where you register referral interest, you consent to me reviewing your details and, where relevant and with your knowledge, presenting your profile to a hiring organisation. Client mandates, salary data and internal information shared with you remain confidential and must not be disclosed or reused.

Bookings, inquiries and referral submissions are stored securely and retained only as long as needed for the purpose above or as required by law.

7. Third parties and external links

The site links to third-party platforms including LinkedIn, Google Calendar, Google Meet, Recruitment Room and RR JobCopilot at https://jobcopilot.recruitmentroom.net/. I do not control those services and accept no responsibility for their availability, content, pricing, terms or handling of your data.

Case studies, metrics and outcomes shown on the site are illustrative of past work. Past results are not a prediction or warranty of future results.

8. Limitation of liability

To the maximum extent permitted by law, the services and the site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.

To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of employment, income, profits, opportunity, offers, goodwill, data, business or anticipated savings, arising out of or in connection with the site, the services, any referral or any hiring decision — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not I was advised of the possibility of such loss.

Where liability cannot lawfully be excluded, my total aggregate liability for all claims arising from or relating to the site or a service is limited to the fees you actually paid to me for that specific service in the three (3) months preceding the event giving rise to the claim, or USD 100 where no fees were paid.

Nothing in these terms excludes liability for fraud, wilful misconduct or any liability that cannot be excluded under applicable law.

9. Indemnity

You agree to indemnify and hold me harmless against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from information you provided, your breach of these terms, your use of any recommendation or introduction, or any dispute between you and an employer, candidate, client or third party.

10. Intellectual property

All site content, frameworks and methodologies — including The Brian Itumo Talent Intelligence Framework™, the Executive Leadership Mapping Framework™ and the AI Recruitment Transformation Framework™ — together with reports, templates and written materials, remain my intellectual property.

You receive a personal, non-transferable licence to use deliverables for the purpose of the engagement. You may not resell, republish, sublicense, train models on, or redistribute them without my written consent.

11. Equal opportunity and lawful hiring

I support fair, non-discriminatory hiring. I do not accept mandates or instructions that require unlawful discrimination, and I cannot influence or override a client's internal hiring criteria, assessment outcomes or decisions.

12. Changes, termination and governing law

I may update these terms at any time; the version published on this page at the time you use the site or purchase a service applies. Material changes will be reflected in the "last updated" date above.

I may decline, pause or terminate any engagement, referral consideration or site access where there is misrepresentation, abusive conduct, non-payment or a conflict of interest.

These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you in your country of residence.
